The consultant became the first firm to be convicted under the Corporate Manslaughter and Corporate Homicide Act 2007.
Alex Wright, a 27-year-old geologist, died in September 2008 when a deep unsupported trench that he was working in collapsed. Cotswold Geotechnical Holdings, his employer, was found guilty of safety breaches and was fined £385,000 at Winchester Crown Court in February this year.
The Lord Chief Justice Lord Judge upheld the conviction and the fine at the Court of Appeal in London yesterday.
Lord Judge said it was "unavoidable and inevitable" that the company would probably have to go into liquidation to pay the fine.
