Spain’s competition watchdog extends asphalt probe

27 Feb 12 Spain’s National Competition Commission (CNC) is extending its investigation into the asphalt sector to include five additional companies.

The investigation, which began in June, will now look at Siecsa Construcción y Servicios SA, Infraestructuras del Norte SL, Hnos Torres Roiz SL, Construboc 2002 SL and Cuevas Gestión de Obras SL.

Fines totalling €16m (£13m) had been issued in November 2011 to 11 other companies.

Opening of the proceedings results from a confidential probe opened by CNC’s investigations division and from inspections carried out on 6 April 2011 as part of an investigation at the head offices of various companies in the sector.

The purpose of the inspections was to verify actions by the companies concerned that could constitute prohibited restrictive practices. This consists of the adoption of agreements to fix prices and share out jobs and customers, both public and private.

CNC’s investigations division became aware of information in the course of the investigation pointing to the participation of other parties who could be responsible for these collusion. It therefore decided to extend the decision to open proceedings in relation to restrictive practices of the kind prohibited by the Spanish Competition Act to the five companies.

The maximum period of 18 months for the investigation of the case and its resolution by the CNC which began on 22 June 2011 remains on target. The opening of the proceedings does not prejudge the final outcome of the investigation, said CNC.
